Agreement to these terms

These Terms of Service (“Terms”) govern your access to and use of Rhythm, software provided by Avero Systems LLC (“Avero Systems,” “we,” “us,” or “our”). By installing, configuring, or using Rhythm, you agree to these Terms. If you use Rhythm on behalf of an organization or household, you represent that you have authority to accept these Terms for that organization or household.

What Rhythm provides

Rhythm is a Windows-first family activity application that provides local activity collection, local dashboard views, reports, diagnostics, and optional integrations such as Gmail-based report delivery. Features may vary by version, license, configuration, and release stage.

Authorized and responsible use

You may use Rhythm only for lawful purposes and only on devices, accounts, and networks you own or are authorized to administer. You are responsible for:

  • providing legally required notices and obtaining legally required consent from people whose activity may be processed;
  • complying with child-privacy, monitoring, employment, education, communications, and data-protection laws applicable to your use;
  • protecting administrator credentials and controlling access to the local dashboard and reports;
  • selecting appropriate report recipients and verifying that they are authorized to receive report content; and
  • maintaining the security, updates, backups, and configuration of the computer running Rhythm.

You may not use Rhythm for unlawful surveillance, harassment, discrimination, unauthorized access, or any purpose that infringes another person’s rights.

Google and Gmail features

Connecting Gmail is optional and requires authorization through Google. If enabled, Rhythm uses send-only Gmail access to send messages configured by you. Your use of Gmail remains subject to Google’s terms and policies. You can disconnect Gmail through Rhythm or revoke access through your Google Account. Details appear in the Rhythm Privacy Policy.

License and ownership

Subject to these Terms and any applicable order or license terms, Avero Systems grants you a limited, non-exclusive, non-transferable, revocable right to install and use Rhythm for its intended purpose. Rhythm, its design, software, documentation, names, logos, and other materials are owned by Avero Systems or its licensors and are protected by applicable intellectual-property laws.

You may not copy, sell, sublicense, rent, distribute, reverse engineer, bypass license or security controls, interfere with product operation, or use Rhythm to develop a competing product except where applicable law expressly permits an activity that cannot be contractually restricted.

Preview and evolving features

Rhythm may include preview, pilot, beta, or evaluation features. These may change, be interrupted, contain errors, or be discontinued. Do not rely on preview features as the sole means of protecting a person, enforcing a rule, preserving evidence, or responding to an emergency.

Updates and changes

We may update Rhythm to improve functionality, compatibility, reliability, privacy, or security. We may also modify or discontinue features. You are responsible for installing required updates when they are not applied automatically.

Our Privacy Policy explains how Rhythm and the Rhythm website handle information and is incorporated into these Terms.

Third-party services

Rhythm may interoperate with third-party products and services. Avero Systems does not control those services and is not responsible for their availability, security, terms, or data practices. Third-party terms may apply to your use of them.

Disclaimers

To the maximum extent permitted by law, Rhythm is provided “as is” and “as available.” Avero Systems disclaims implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing. We do not warrant that Rhythm will be uninterrupted, error-free, tamper-proof, or suitable as the sole basis for parenting, safety, legal, employment, educational, or disciplinary decisions.

Limitation of liability

To the maximum extent permitted by law, Avero Systems and its members, employees, contractors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or opportunities arising from or related to Rhythm. Our aggregate liability arising from Rhythm will not exceed the amount you paid Avero Systems for Rhythm during the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.

Suspension and termination

You may stop using Rhythm at any time. We may suspend or terminate access to licensed features if you materially violate these Terms, misuse the product, fail to pay applicable fees, or create a security or legal risk. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, and dispute provisions.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute not subject to another written agreement will be brought in the state or federal courts located in Dallas County, Texas, and each party consents to their jurisdiction and venue.

Changes to these terms

We may update these Terms. We will post updated Terms at this URL and revise the effective date. Continued use after updated Terms take effect constitutes acceptance where permitted by law.
